Terms of Use

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Phovio. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using Phovio, you represent that you meet these requirements.

2. Description of the Service

Phovio is an AI-powered creative platform that lets you generate photos, videos, and audio using third-party artificial intelligence ("AI") models, apply curated "Trends" templates, and share prompts through a community "Prompt Hub."

AI-generated output is produced automatically and may be inaccurate, unexpected, or not what you intended. We do not guarantee the quality, accuracy, suitability, or availability of any generated content, and the Service is provided on an "as is" basis (see Section 10).

3. Accounts and Device-Based Identity

Phovio uses anonymous authentication — you do not need to provide an email or password. Your identity is tied to an anonymous account ID and your device identifiers, which keep your credits and subscriptions associated with you (including across reinstalls, where possible). You are responsible for activity that occurs through your device and account.

4. Credits, Purchases & Subscriptions

Credits. AI generations consume credits. You can obtain credits by purchasing one-time credit packs or through a subscription. Some features cost more credits than others.

Subscriptions and auto-renewal. Subscriptions (such as weekly, monthly, and annual plans) automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Billing. All purchases are processed by the Apple App Store or Google Play and managed through RevenueCat. We do not receive or store your payment card details. Prices may vary by region and are subject to change.

Credit behavior.

• Credits associated with a subscription period do not carry over after the period ends or the subscription expires.
• Credits from one-time packs remain available until used, subject to these Terms.
• Credits have no monetary value, are not redeemable for cash, and are non-transferable.
• Where a generation fails, credits may be refunded back to your in-app balance according to our automated credit ledger.

Refunds. Purchases are generally non-refundable except where required by law. Refunds for payments are handled by Apple or Google under their respective policies — please direct refund requests to the relevant store.

Cancellation. You can manage or cancel subscriptions in your Apple App Store or Google Play account settings.

5. Acceptable Use

You agree not to use Phovio to create, upload, share, or distribute content that:

• Is illegal, or promotes illegal activity;
• Depicts a real person without their consent, including non-consensual, sexual, or misleading "deepfake" content;
• Uses another person's face, likeness, voice, or image without the necessary rights or permissions (this is especially important for face-swap and voice features);
• Is sexually explicit, involves minors in any sexual or exploitative manner, or is otherwise abusive;
• Is hateful, harassing, threatening, defamatory, or incites violence;
• Infringes intellectual property, privacy, publicity, or other rights of others;
• Impersonates any person or entity or misrepresents your affiliation;
• Contains malware, or attempts to disrupt, overload, scrape, reverse-engineer, or gain unauthorized access to the Service or its providers.

You are solely responsible for the content you upload and generate and for ensuring you have all rights necessary to do so.

6. User Content and AI Output

Your content. You retain ownership of the original photos, audio, video, and text you upload ("Your Content"). You represent that you have the rights to use Your Content and to grant the license below.

License to us. You grant Phovio a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and transmit Your Content solely to operate and provide the Service — including sending it to the AI and infrastructure providers described in our Privacy Policy to generate your output and to deliver, store, and display your results to you.

AI output. Subject to these Terms and the terms of the underlying AI providers, you may use the content you generate for personal or commercial purposes, to the extent permitted by applicable law. You are responsible for how you use generated content. Because of how AI models work, similar output may be generated for other users, and we make no exclusivity guarantee.

7. Community Content (Prompt Hub)

If you publish to the Prompt Hub:

• Your submission becomes publicly visible and may be used by other users to generate their own content. You may post under a nickname or anonymously.
• You grant other users and us the right to view, use, and display your published prompts within the Service.
• All submissions are subject to moderation and must comply with Section 5.
• We may apply rate limits (for example, limits on daily submissions and reports) to prevent abuse.
• Users may report content; we may remove content, reject submissions, or restrict accounts that violate these Terms, at our discretion and without notice.

8. Intellectual Property

The App, including its software, design, branding, trademarks, logos, and curated Trends, is owned by Chvelia Studio and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service. You may not copy, modify, distribute, or create derivative works of the App except as permitted by law.

9. Third-Party Services

Phovio relies on third-party services, including AI providers (such as Google and Replicate), Firebase, RevenueCat, Cloudflare, and the app stores. Your use of the Service may also be subject to those parties' terms. We are not responsible for third-party services and disclaim liability for their acts or omissions.

10. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT AI-GENERATED OUTPUT WILL BE ACCURATE, RELIABLE, APPROPRIATE, OR ERROR-FREE. YOU USE THE SERVICE AND ANY GENERATED CONTENT AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHVELIA STUDIO AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Chvelia Studio and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Suspension and Termination

We may suspend or terminate your access to the Service, or remove your content, at any time and without notice if you violate these Terms or if we reasonably believe your use harms the Service, other users, or third parties (including by banning accounts engaged in abuse). You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 6, 8, 10, 11, and 12) will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide notice in the App. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Istanbul, Turkey, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be resolved in the courts located in Istanbul, Turkey, unless applicable law requires otherwise or grants you rights to bring claims elsewhere.
